Terms of Service

Please read these terms carefully before engaging Paramount Concrete Company LLC for any services. By signing a contract, scope of work, or making a deposit payment, you agree to be bound by these terms.

Section 01

About Us

Paramount Concrete Company LLC ("Paramount Concrete," "we," "our," or "the Company") is a licensed residential concrete flatwork contractor based in Cedar Rapids, Iowa. We provide concrete installation and related services to residential and light commercial customers throughout the Cedar Rapids Corridor and surrounding communities.

Section 02

Acceptance of Terms

By requesting a quote, signing a Scope of Work, Contract, or Estimate, or making any deposit or payment to Paramount Concrete Company LLC, you ("Customer," "Client," or "you") acknowledge that you have read, understood, and agreed to be bound by these Terms of Service in their entirety.

These Terms of Service apply to all projects, services, and agreements entered into with Paramount Concrete Company LLC, whether written or verbal, and supersede any prior discussions, representations, or understandings between the parties.

If you do not agree to these terms, do not sign any contract or make any payment. Contact us at (319) 614-6142 to discuss any concerns prior to engagement.

Section 03

Estimates & Proposals

All estimates and proposals provided by Paramount Concrete Company LLC are based on a site visit and information provided by the customer at the time of the quote. Estimates are valid for 30 days from the date of issue unless otherwise stated in writing.

An estimate is not a binding contract. Work will not begin until a written Scope of Work or Contract has been signed by both parties and the required deposit has been received.

If site conditions, customer requests, or project scope change after the estimate is issued, Paramount Concrete Company LLC reserves the right to revise pricing accordingly prior to commencement of work.

Section 04

Payment Terms

Payment is due in accordance with the schedule outlined in the signed Scope of Work. The standard payment schedule is as follows:

  • 50% deposit — due at signing to secure your project date on our schedule
  • 40% — due upon completion of site preparation and form installation
  • 10% final payment — due upon project completion, final cleanup, and customer approval

Paramount Concrete Company LLC accepts all major forms of payment including cash, check, and all major credit cards. Any applicable processing fees for credit card payments will be disclosed at time of payment.

Failure to remit payment in accordance with the agreed schedule may result in work stoppage, project delays, and/or collection action. Any outstanding balances past 15 days from the due date will accrue interest at the maximum rate permitted by Iowa law.

All change orders, additions, or scope modifications must be paid in full or have an agreed payment schedule in writing prior to additional work being performed.

Section 05

Cancellation Policy

Customers may cancel a signed contract without penalty within 15 days of signing, provided that work has not yet commenced. Cancellations made within this period will receive a full refund of any deposit paid.

Cancellations made after the 15-day window or after work has commenced are subject to the following:

  • The deposit is non-refundable if materials have been ordered, equipment has been mobilized, or work has begun
  • The customer is responsible for the cost of all labor, materials, and expenses incurred by Paramount Concrete Company LLC up to the date of cancellation
  • Paramount Concrete Company LLC reserves the right to recover reasonable costs for lost project scheduling and business opportunity

Cancellation requests must be submitted in writing via email to [email protected] or via certified mail.

Section 06

Change Orders

Any modifications to the agreed scope of work — including additions, deletions, or changes to materials, dimensions, or project specifications — must be documented in a written Change Order signed by both the customer and an authorized representative of Paramount Concrete Company LLC prior to the additional work being performed.

  • Verbal agreements for changes to scope will not be honored
  • Change orders may affect project price, timeline, and scheduling
  • Additional costs associated with approved change orders are due in accordance with the payment schedule outlined in the change order
  • Paramount Concrete Company LLC is not liable for delays resulting from customer-requested changes
Section 07

Project Schedule & Weather

Project start dates are estimates and are subject to change based on weather conditions, material availability, crew scheduling, and other factors outside of our control. Paramount Concrete Company LLC will make reasonable efforts to notify the customer of any scheduling changes as soon as possible.

Concrete installation requires suitable weather conditions. We reserve the right to reschedule pours when temperatures are below 40°F, when heavy rain is forecast, or when conditions would compromise the quality of the finished product. Weather-related delays are not a breach of contract and do not entitle the customer to a refund or price reduction.

Paramount Concrete Company LLC requires that the customer provide clear and safe site access for all crew, equipment, and vehicles on the scheduled project dates. Failure to provide access may result in rescheduling fees.

Section 08

Workmanship Warranty

Paramount Concrete Company LLC warrants that all concrete flatwork performed under a signed contract will be free from defects in materials and workmanship for a period of one (1) year from the date of substantial completion.

Items covered under the standard 1-Year Workmanship Warranty include:

  • Major cracking wider than 1/4 inch, excluding normal hairline shrinkage cracks
  • Excessive settling or unevenness causing water ponding greater than 1/2 inch
  • Scaling or spalling directly resulting from improper installation practices
  • Control joint failure or misalignment caused by our installation
  • Decorative finish defects (stamped, colored, or exposed aggregate work) caused by our workmanship — minor color variation is normal and not covered

This warranty is transferable to future property owners upon written request and compliance with all warranty conditions.

This warranty is in lieu of all other warranties, expressed or implied, to the fullest extent permitted by Iowa law. It does not affect any statutory rights you may have under Iowa state law.

Section 09

Warranty Exclusions

The warranty described in Section 08 does not apply to damage, deterioration, or conditions caused by any of the following:

  • Normal wear and tear, natural shrinkage, or hairline cracking inherent to concrete as a material
  • Iowa freeze-thaw cycles, de-icing chemicals (including but not limited to ammonium sulfate, magnesium chloride, rock salt, or any chloride-based product), or harsh weather conditions
  • Tree roots, soil movement, underground water, or changes in subgrade conditions beyond the Company's control
  • Heavy vehicles, loaded trailers, recreational vehicles, commercial equipment, or any loads beyond standard residential use
  • Alterations, additions, repairs, or modifications made to the concrete by the homeowner, tenant, or any third party not authorized by Paramount Concrete Company LLC
  • Color variations, efflorescence, surface dusting, or tonal inconsistencies, which are common and expected characteristics of concrete including decorative and colored applications
  • Damage caused by snowplows, power washing, improper cleaning agents, or abrasive tools
  • Acts of God including but not limited to flooding, earthquake, fire, or severe storm damage
  • Customer negligence or failure to follow the Maintenance Guide provided at project completion
  • Any issues not reported in writing within 14 days of discovery

Concrete is a natural material. Some degree of hairline cracking, minor color variation, and surface variation is inherent to concrete and is not considered a defect. These are not covered under warranty.

Section 10

Satisfaction Guarantee

Paramount Concrete Company LLC stands behind its work 100%. If you are not completely satisfied with the quality of the finished project, you must contact us in writing within 15 days of project completion. We will schedule an inspection and work with you in good faith to resolve the concern.

The satisfaction guarantee applies to quality of workmanship issues within our control. It does not apply to aesthetic preferences that differ from what was specified in the signed Scope of Work, or to conditions excluded under Section 09.

Final payment constitutes customer acceptance of the completed work unless written notice of a defect has been provided prior to or at the time of final payment.

Section 11

Customer Responsibilities

To maintain warranty validity and ensure a successful project, the customer agrees to the following responsibilities:

  • Provide clear, safe, and unobstructed access to the project site for all crew, vehicles, and equipment on scheduled work dates
  • Notify Paramount Concrete Company LLC of any underground utilities, irrigation systems, or buried infrastructure not identified during the initial site visit
  • Keep children, pets, and unauthorized persons off the project site during active work and throughout the concrete curing period
  • Avoid foot traffic on new concrete for a minimum of 24–48 hours and vehicle traffic for a minimum of 7 days after completion
  • Avoid use of de-icing chemicals or salts on new concrete for a minimum of one full winter season (approximately one year) after installation
  • Follow the Maintenance Guide provided at project completion
  • Report any warranty concerns in writing within 14 days of discovery and allow reasonable access for inspection and repair
  • Ensure payment is made in accordance with the agreed schedule
Section 12

Limitation of Liability

To the fullest extent permitted by applicable Iowa law, the total liability of Paramount Concrete Company LLC for any claim arising out of or related to a project — whether in contract, tort, warranty, or otherwise — shall not exceed the total amount paid by the customer for the specific project giving rise to the claim.

Paramount Concrete Company LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of use, loss of revenue, loss of enjoyment of property, or cost of alternative accommodations arising from a project delay or defect.

Paramount Concrete Company LLC carries general liability insurance. Proof of insurance is available upon written request.

Section 13

Photography & Marketing Rights

By engaging Paramount Concrete Company LLC for any project, the customer grants Paramount Concrete Company LLC a non-exclusive, royalty-free, perpetual license to photograph and/or record completed projects and to use those images and recordings for any lawful marketing, advertising, or promotional purposes.

This includes but is not limited to use on the Company's website, social media platforms (including Facebook, Instagram, Google, and others), digital advertising, print materials, and any other promotional channels.

Photos will be taken of the completed work only and will not include identifiable images of customers, residents, or minors without explicit written consent. Property addresses will not be published without the customer's permission.

If you prefer that your property not be photographed, please notify Paramount Concrete Company LLC in writing prior to project commencement.

Section 14

Dispute Resolution

In the event of a dispute arising from any project or these Terms of Service, both parties agree to first attempt to resolve the matter in good faith through direct communication. Paramount Concrete Company LLC will respond to all written disputes within 5 business days.

If the dispute cannot be resolved informally, both parties agree that any legal action or proceeding shall be brought exclusively in the state or federal courts located in Linn County, Iowa. Both parties consent to personal jurisdiction and venue in such courts.

In any legal proceeding arising from this agreement, the prevailing party shall be entitled to recover reasonable attorneys' fees and costs to the extent permitted by Iowa law.

Section 15

Governing Law

These Terms of Service and any agreements between the customer and Paramount Concrete Company LLC shall be governed by and construed in accordance with the laws of the State of Iowa, without regard to its conflict of law provisions.

If any provision of these Terms of Service is found to be unenforceable or invalid under applicable law, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.

Paramount Concrete Company LLC reserves the right to update or modify these Terms of Service at any time. Updates will be posted to the Company's website and will apply to all projects commencing after the effective date of the update.
